GENERAL TERMS AND CONDITIONS SIMPLEWAS V.O.F.

Article 1 - Definitions

In these terms and conditions, the following terms are defined as:

• Reflection period: the period during which the consumer can exercise the right of withdrawal;

• Consumer: the natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the entrepreneur;

• Day: calendar day;

• Durable contract: a distance contract relating to a series of products for which the delivery obligation is spread over time;

• Durable data carrier: any tool that enables the consumer or entrepreneur to store information in a way that allows future access and unaltered reproduction;

• Right of withdrawal: the option for the consumer to withdraw from the distance contract within the reflection period;

• Withdrawal form: the form provided by Simplewas for the use of the right of withdrawal;

• Entrepreneur: Simplewas V.O.F., who offers products to consumers at a distance;

• Distance contract: a contract concluded exclusively using remote communication methods within a system organized by the entrepreneur;

• Remote communication technology: a means that can be used to conclude a contract without simultaneous physical presence.

Article 3 - Applicability

1. These terms and conditions apply to every offer from Simplewas and every distance contract concluded.

2. The consumer is informed of these terms before the agreement is concluded.

3. In the case of electronic conclusion, the terms are made available in a way that enables durable storage.

4. In the case of supplementary terms, the most favorable condition for the consumer applies.

5. If provisions are null or voided, the remaining provisions remain in effect.

Article 4 - The Offer

1. The offer includes a clear description of the products. Images are representative.

2. Clear information about price, shipping costs, payment method, delivery method, and withdrawal rights is provided.

3. Mistakes in the offer do not bind Simplewas.

Article 5 - The Agreement

1. The agreement is concluded when the consumer accepts the offer.

2. Simplewas confirms receipt of the electronic order immediately.

3. Simplewas ensures appropriate technical and organizational security measures.

4. Simplewas may refuse orders or impose conditions in case of payment doubts.

5. Upon delivery, all necessary information is provided in writing or on a durable medium.

Article 6 - Right of Withdrawal

1. The consumer has a 30-day reflection period after receiving the product.

2. The product may only be used as far as needed for assessment.

3. The product must be returned within 14 days after withdrawal notification.

4. If no timely notice or return occurs, the purchase is final.

Article 7 - Costs in Case of Withdrawal

1. Return shipping costs are at the consumer's expense.

2. Simplewas will refund within 14 days after receipt of return or proof thereof.

3. Shipping costs may be deducted, depending on the country.

Article 8 - Exclusion of the Right of Withdrawal

1. Simplewas may exclude the right of withdrawal for products with:

   • Personal specifications

   • Hygienic seals that have been broken

   • Short shelf life or custom work

   • Other exclusions as permitted by law

Article 9 - Prices

1. Prices include VAT and are valid within the indicated term.

2. Price changes due to VAT changes are permitted.

3. Errors in price listings do not bind Simplewas.

Article 10 - Conformity and Warranty

1. Products comply with the contract and legal requirements.

2. Guarantees do not affect statutory rights.

3. Complaints about defects must be reported within 4 weeks.

Article 11 - Delivery and Performance

1. Delivery takes place at the address provided by the consumer.

2. Orders are delivered within 30 days unless otherwise agreed.

3. In case of delay, the consumer has the right to cancel free of charge.

4. The risk of damage remains with Simplewas until delivery.

Article 12 - Duration Contracts

1. The consumer may cancel an indefinite contract with a notice period of one month max.

2. Renewal of fixed-term contracts is only permitted under certain conditions.

Article 13 - Payment

1. Payment must be made within 7 business days after the start of the reflection period.

2. Errors in payment details must be reported immediately.

3. Simplewas may charge fees in case of non-payment.

Article 14 - Complaints

1. Complaints must be reported within 7 days after discovery of the defect.

2. Complaints are answered within 14 days.

3. Unresolved complaints are subject to dispute resolution.

Article 15 - Disputes

1. Dutch law applies to all agreements.

2. Only the court in Groningen has jurisdiction.

3. The Vienna Convention on Contracts for the International Sale of Goods does not apply.

Article 16 - Additional Provisions

1. Additional provisions may not be to the detriment of the consumer.

2. These must be recorded in writing or on a durable medium.
